Open Containers II: No Minors

We talked recently about open container laws.  They are not a bad idea.  It saves lives to keep alcohol out of a car and the human bloodstream while driving.

Intoxication and driving are never a good idea — especially when it involves minors. An open container citation can yield a $250 fine for an adult.  But an open container citation for a driver under 21 has far more serious consequences, including the following:

  • Loss of license: A minor facing an open container ticket can lose his or her driving privileges for a year or see acquisition of his or her license delayed for one year.
  • Loss of car: A minor’s car can be impounded at his or her expense.
  • Costly fine: While the fine for adult violation of open container laws is relatively light, conviction of a minor under the same law can result in a $1,000 fine.
  • Conviction: In California, an adult faces an infraction, but a minor faces a misdemeanor upon conviction for drunk driving.

Exceptions exist for minors directed by an employer, or accompanied by a legal guardian, but otherwise?  Keeping alcohol away from minors is just good sense.
